The space
A 50 foot lap pool in a private backyard and a roof top spa accent this Key West style home. The roof top deck and the crow's nest afford exceptional views of the intracoastal waterway. Great for sunrise and sunset views. No activities on the front lawn or porch including but not limited to Yoga, Sports, Bounce houses, Parties, Meetings, etc. No placement of any decorations or objects on the front porch, lawn area or driveway.

Guest access
Guests have access to the main house and private back yard pool area. Owners live in an adjacent sequestered cottage and are available to assist in needs while renting. No activities on the front lawn including but not limited to Yoga, Sports, Bounce houses, Parties, Meetings, etc. No placement of any decorations or objects on the front lawn area or driveway.

Other things to note
The owner stays in the cottage adjacent to the house during the stay of guests. Acceptance of a booking is confirmation of all house rules. If a potential renter wishes to review the contract prior to making a reservation please message the owner and they will gladly send to your email.
The use of the swimming pool, spa, bikes, kayak and any equipment provided and used are at the own risk of the renters and or guests.
Our home is in a residential community and for Security we have Ring cameras for the perimeter of the property. We request that our home and vacation rental be treated as if it were your home and that you respect our Neighbors. You are required to keep all noise, conversation volume and internal music down to a minimum. No external to the house music is allowed. Noise limits are in effect on this property as per city regulations. Noise is to remain on the property and if Police are brought to the house there will be a $250 penalty (per occurrence) reduced from the security deposit, along with any fines (that are guest responsibility) issued by the police. Tobacco and Marijuana use is prohibited (No smoking, No vaping) and if smoking rules are not followed immediate eviction may occur additional charges for cleaning may occur as there are additional expenses for cleaning and attempting to remove odor from the home. Similarly, Pets are prohibited, if animals are brought onto the property and/or into the house there may be immediate eviction and there are additional expenses for cleaning. If a late checkout is requested and is available based on schedule, the guest can pay an additional $250 to stay until 3 PM. For-hire personnel must be approved by the owners before the stay and submit liability coverage to the renter and then to the owners. Hibachi chefs and are prohibited. SHORT TERM RENTAL AGREEMENT

This Short-Term Rental Agreement (the “Agreement”) is made by and between Susan Kunkel (“Homeowner”) and Guest Booking Stay (Must be over 30 Years of age and present ID at time of arrival) (“Guest”) as of the date last set forth on the reservation through specific platform. The person who booked the rental must check in and stay for the duration of the booking. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

1. Property. The property is located at: 123 Santa Lucia Drive, WPB Fl 33407 The property is furnished and includes a kitchen with necessary items for meal preparation and delivery. The owners also live on the property in a cottage with a private entrance and sequestered yard space.

Maximum Occupancy: The maximum number of guests is limited to 19 persons. Additional persons staying or visiting on the property will void this agreement and the guests will be asked to leave the property. The person or persons attending the check in tour is responsible to notify all guests of the information especially the noise restrictions in the house rules. All guests are responsible to follow the house rules. Failure to do so can result in eviction and loss of reservation. The owners also live on the property in a cottage and may monitor occupancy limits periodically during the rental period. The maximum occupancy for the house is eighteen (19) (4 bedrooms) , media room and a study unless agreed upon by owner and Guest.

2. Term of the Lease. The lease begins at 4p.m. on first day of reservation in the listing platform the “Check-in Date”) and ends at 10 a.m. on the last day of reservation in the listing platform (the “Check-out Date”). THERE CAN BE NO LATE CHECK OUT DUE TO PROPERTY OBLIGATIONS FOLLOWING YOUR RENTAL PERIOD. A fee for loss of property income due to a late check out affecting subsequent property rental will be taken from the security deposit or charged to Guest.

3. Minimum Stay: This property requires a 3-night minimum stay. Longer minimum stays may be required during holiday periods. If a rental is taken for less than 3 days, the guest will be charged the 3-night rate.

4. Rental Rules: Guest agrees to always abide by the Rental/House Rules as described below while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property. All Guests must be listed in the platform agreement.

RENTAL RULES
a. Smoking: Smoking is NOT allowed on the property unless agreed upon in writing by owner. Forfeiture of entire deposit will occur if smoking of any kind occurs on the property
b. Guests: People other than those in the Guest party set forth above may not enter the property or stay overnight on the property. Guests are not allowed to exceed the occupancy limit agreed to above. If additional person(s) arrive on the property other than listed in the platform reservation, the reservation can be voided and all guests evicted
c. Noise: Guests should not create excessive noise at a level that disturbs neighbors; Code-enforced neighborhood quiet hours are from 10:00p.m. – 8:00a.m. Any fines incurred will be deducted from the security deposit or charged to Guest. House rules though are stricter and do not allow outside noise after 6PM and before 8AM. Noise during this time must remain on the property.

House Rule, Limit Noise Disturbance
Noise is to remain on the property and if Police are brought to the house at any time during your stay there will be a loss of deposit if Police are called to the Property. We follow the West Palm Beach Noise Control regulations. Please respect the peace and tranquility of our home and limit disturbing or having uninvited noise in our neighbors’ homes.
1. Our property line is shared with multiple neighbors, and with proximity we are sharing the same backyard.
2. It is unlawful for any person to make or continue any unreasonably loud, excessive, unnecessary, or unusual noise.
3. Minut noise monitoring devices are located on the property and will monitor noise levels. (24 hours day) and will notify guest if excessive noise occurs on the property.
4. Noises that are unnecessary and excessive are prohibited and must be limited.
5. Especially limit noise between the hours of 10 P.M. and 8 A.M, limit conversation volume, and prevent loud raucous noise as much as possible i.e., shouting, screaming, high pitched noise, expletives (Cursing) OR any noise which unreasonably disturbs the peace and tranquility of our home.

6. Please be aware that Noise travels, especially when outdoors on roof, balcony or pool areas so please keep noise to a minimum.
7. Music is Prohibited unless authorized.

8. Please limit sound traveling onto neighbor’s property. No music should be played as conversations increase and cause noise to exceed noise limit thresholds.
9. There are plenty of bars/clubs around for parties or loud music.
10. We MUST be notified of any written warning AND /or Police presence on our property during your stay.

11. Safety: The property is privately owned; the owners are not responsible for any accidents, injuries or illnesses that occur while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the Guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm to their persons or their property arising from their use of the premises or others whom they invite to use the premise.
12. Property: Keep the property and all furnishings in good order as prior to the rental period.
13. Appliances: Only use appliances for their intended uses.
14. Pets: Pets are NOT allowed.
15. Parking: Parking is limited to 5 vehicle(s) on the property. Vehicles are to be parked in designated parking areas only. Parking on the road is permitted for additional vehicles.
16. Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from the home. A washer and 2 dryers are located on the premises
17. Garbage: Any garbage must be stowed in the proper garbage or recycling receptacle, located at the side of the house. Place garbage bins by curb, before 6 A.M. for trash pickup on Tuesday and Friday morning. Trash receptacle must be left curbside with flat portion facing the road. Recyclables are picked up on Tuesday.
18. Hot Tub: No children under the age of 15 are permitted in hot tubs without adult supervision. When using the hot tub, remember there is a certain health risk associated with hot tub use. Use at your own risk. Our housekeepers drain, sanitize, refill and replenish chemicals in all tubs prior to your arrival; therefore, it may not be warm until later that evening. [DO NOT STAND ON THE HOT TUB COVERS. Hot tub covers are for insulation purposes and are not designed to support a person or persons. They will break and you will be charged for replacement.] Remember when not using the hot tub, leave the cover on so the hot tub will stay warm. DO NOT SIT ON THE ROOF DECK RAILING located near the spa on the 3rd floor.
19. Railing. Absolutely, NO SITTING ON THE RAILINGS on the 2nd or 3rd or 4th floor outdoor decks. There is a risk of falling from the railing.
20. Parental Supervision: Children must always be supervised in the 1st level pool area, along with 2nd, 3rd and 4th floor outdoor deck areas.
21. Fireplace: Master bedroom has a wood burning fireplace. This is not for use by the Guests.
22. Elevator: To prevent need for elevator maintenance, Do Not open any of the doors when riding the elevator until the elevator stops and the destination floor number that was lit, turns off. If opened the elevator safety will result in the elevator dropping below the level of the floor incapacitating the elevator. There is a $250 technician service charge which will be charged to the security deposit from improper use.
23. Sewer System. The house is on a city water system. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at any time. If items other than toilet paper are found flushed and clog the sewer system, a technician service charge to repair will be deducted from the security deposit or charged to Guest.

24. Storms: No refunds will be given for storms. The house has “Hurricane Windows” which do not need external protection during a storm. In case of a pending hurricane, the location of the property is an evacuation zone. Due to unexpected rain showers, all windows and doors must be closed prior to leaving the house each day.
25. Access: Guest shall allow Homeowner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.
26. Cancellation Policy: If Guest wishes to cancel his/her reservation, the rental fees will be refunded as per the vacation rental company’s policies or this contractual obligation.
27. Insurance: We encourage all renters to purchase traveler insurance. Also as per the contractual agreement with VRBO, Property damage protection (PDP) ($99.00) must be purchased and assigned to Susan Kunkel the property owner.
28. If legal action occurs as a result of breach of this contract, excessive damage to the property about that of the insurance and/or deposit, loss of income for future rentals due to actions by the Guest, then the prevailing party shall have the right to collect from the other party all reasonable costs, disbursements and attorneys' fees incurred in enforcing this Agreement and to prove the amount of fees.
29. By signing this contract, Guest waives all liability and responsibility of Owner for Guests’ use or operation of the following:
i. Use of the Bikes
ii. Use of the Dumbwaiter
iii. iii. Use of the Elevator
iv. iv. Use of Golf Equipment
v. v. Use of the Hot tub
vii. Use of the Swimming Pool
viii. Use of any and all equipment, furniture, appliances related to the vacation rental property
30. Any purchase through Amazon Prime will be charged to the guest and/or deducted from the deposit or charged back.

5. Property Condition: Guest accepts the property in its present condition and agrees to keep said premises in a good clean condition; to make no alterations or additions to the same; to commit no waste thereon; to obey all laws and ordinances affecting said premises; to replace glass broken or cracked; to repay the Owner the cost of all repairs made necessary by the negligent or careless use of said premises; and, to surrender the premises at the termination hereof in like condition as when taken reasonable wear and damage by the elements excepted, Guest further covenants and agrees to repay the Owner the cost of all repairs made necessary by or damages resulting from Guest’s negligent or careless use of the premises and the appliances, equipment and fixtures. Guest further covenants to immediately upon discovery notify the Owner of any defect, breakdown or damage to the premises and any of Owner’s property regardless of cause.

6. Security Deposit: Guest’s security deposit shall be held by Owner as security for Guest’s performance of this lease, and against any damages caused to the property or any other part of Owner’s property by Guest. Guest is, hereby, notified that said deposit will
be held by Owner in a non-interest bearing account not apart from other funds. Owner will refund the unused balance of Guest’s security deposit within 15 days after any damages are valued or per Vacation rental company’s policy. Guest further covenants and agrees that if, for any reason whatsoever, the Owner is unable to deliver the property in accordance with the provisions hereof, it is agreed that the Owner’s liability shall be limited to the return of the payment made by the Guest on or prior to the signing of this lease, and upon the return of said sum, this lease shall be null and void.

7. Check-Out Date: Guest agrees that upon the expiration of said term, or upon the termination of the Lease for any cause, Guest will at once peacefully surrender and deliver up the whole of the above described premises together with all improvements thereon to the Owner, her agents and assigns. Guest further covenants that Guest will leave the premises in the exact state of repair and condition as Guest found it at the beginning of the stay, subject to reasonable wear and tear. In the event the premises are not left in a condition similar to the condition the premises were in when Guest accepted the premises, then the security deposit will be used by the Owner to restore the premises to their former condition. In the event the damage done or caused by the Guest exceeds the amount held by the owner as Security Deposit, the Owner will repair the damage and the Guest shall remain liable for any balance. The balance due must be paid within five (5) days after Owner has demanded payment for said balance.

8. Owner’s Liability: The Guest understands and agrees that Owner shall not be liable for property damage or personal injury occurring in the premises or elsewhere on Owner’s property regardless of cause unless the damage or injury results from Owner’s negligence or intentional tort; and, further, Guest agrees to defend, indemnify and save Owner harmless from any and all such claims of every kind and nature. Guest must obtain insurance to provide protection from said property damage or personal injury and must name Owner as an additional insured.

9. Additional Rules: The Guest covenants and agrees that all rules and regulations printed herein, or hereafter adopted by the Owner and made known to Guest, shall have the same force and effect as covenants of this lease, and the Guest and all family and guests will observe all such rules and regulations.

10. Late Check-Out: The Guest will be liable for double the amount of rent for any holdover period in addition to all other damages suffered by Owner.

11. Attorney’s Fees: The Guest agrees that should it become necessary for the Owner to secure the service of an attorney to enforce any of the provisions of this lease, Guest shall be responsible for any and all reasonable attorney’s fees incurred by the Owner, whether it was necessary for the attorney to institute legal action or enforce the terms of the lease without the institution of a legal action, and for attorney’s fees to prove the amount of fees.
12. Complete Agreement: This lease contains the complete expression of all agreements between the parties hereto and there are no promises, representations or inducements except as herein set forth, and no change shall be made in any of the terms and conditions hereof, unless made in writing and signed by both parties hereto.
13. Florida Law: It is expressly understood and agreed that this Agreement is made pursuant and subject to the laws of Florida and in the event that any part of this Lease is construed as unenforceable, the remaining parts of this Lease shall continue in full force and effect as though any unenforceable part or parts were not written into this Lease.
14. Payment: As per Vacation rental company’s policies or this contractual obligation, full payment as stated on the Booking Confirmation is due immediately upon signing this Agreement.
15. Any contractor or service provider brought onto the property must have liability insurance delivered by the guest to the property owner before arrival. The guest must notify the property owner prior to the stay of any service provider to be brought onto the property.

By Guest’s booking, I hereby agree to all of the rental terms; I agree that all rental monies are refundable as per cancellation policy of Vacation rental Company or this contractual obligation; and I have read my rights to purchase travel insurance.

The parties agree to the terms of this Short-Term Rental Agreement, as evidenced by the completion of the reservation booking.

I (The Renter) Understand that this is a Short-Term Rental and any day(s) extension to the agreement would require written agreement by the homeowner for that to occur. Any person (s) who remain(s) on the property after the departure date and time will be trespassing and police will be summoned for eviction.

NOTICE OF NOISE RULES
Due to the issues associated with party houses, vacation rental companies have policies & procedures we must follow, to avoid disruptive events at our rental property. In addition, our insurance policy requires that we install noise monitoring devices. We have Minut home sensors throughout our property, which are camera-free, and sensors measure sound levels without recording or listening. The devices ensure party prevention, noise monitoring, guest privacy and home security. We have pre-set threshold which follow noise code ordinance levels for the City of WPB and if noise level exceeds the threshold for a specified duration of time (5-15mn) Minut will start to flash, sound and Guest will be contacted. Should someone try to remove Minut from its mounting plate, we will be instantly notified. No amplified music. Please limit noises that are unnecessary and excessive (i.e. shouting, screaming, high pitched noise) If guest host a disruptive event and/or police are called to the property, this may result in cancellation of reservation & eviction. Pool and roof tops decks closed from 10PM to 8 AM

Cancellation policy

A deposit of 10% of the rental amount is part of the total rent payment and is non-refundable. In case of cancellation, the tenant will forfeit the deposit, and the remaining rent will not be charged.
